By creating an account or using FormUpdates.com and related apps/portals (the "Service"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the Service.
You must be 18+ and able to form a binding contract. If you use the Service for a company/organization, you represent you have authority to bind it and will follow applicable laws and your internal policies.
FormUpdates is a secure workflow tool that may help you: collect information via links (email/text), upload documents, extract data (including ID/driver's license features if enabled), populate forms, send documents for e-signature (e.g., DocuSign), deliver completed forms securely to institutions, and sync data to CRM systems when enabled.
FormUpdates does not provide legal, tax, or compliance advice, and does not guarantee that extracted data or generated forms are error-free. You are responsible for reviewing and approving outputs before sending.
You are responsible for:
Notify us promptly of suspected unauthorized access.
If you collect IDs (e.g., driver's licenses) or other sensitive data using the Service, you represent you have a lawful basis and required consent/authorization to collect and process it, and you will comply with privacy and data protection laws. Unless explicitly agreed in writing, FormUpdates does not verify identity or prevent fraud.
You consent to receive electronic communications (email, in-app, and text where enabled). You agree electronic records/signatures may be valid where permitted by law. You are responsible for obtaining any required consent from recipients you message through the Service.
You will not: misuse the Service; upload malware; attempt unauthorized access; scrape or reverse engineer; disrupt operations; send spam; process data you aren't authorized to access; or violate any law or third-party rights.
We may suspend or terminate access for violations, security risk, suspected fraud, legal compliance needs, or nonpayment (if applicable).
You retain ownership of data you upload or collect through the Service ("Customer Data"). You grant FormUpdates permission to host, process, transmit, and display Customer Data to provide, secure, and improve the Service and enabled integrations. You are responsible for accuracy, legality, required notices/consents, and retention/export decisions.
The Service may integrate with third parties (e.g., DocuSign, CRM, messaging providers). Those services are governed by their own terms and policies. FormUpdates is not responsible for third-party outages, changes, or data handling outside our systems.
FormUpdates and its software, UI, and branding are owned by us and our licensors. We grant you a limited, revocable, non-transferable license to use the Service for your internal business purposes. You may not copy, sell, or reverse engineer the Service.
Plans, fees, usage limits, and billing terms are described at signup or in an order form. Unless required by law or stated in writing.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (INCLUDING ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT) AND DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FORMUPDATES IS NOT LIABLE FOR INDIRECT OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS OR DATA). OUR TOTAL LIABILITY WILL NOT EXCEED THE AMOUNTS PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF NONE WERE PAID), EXCEPT WHERE PROHIBITED BY LAW.
You agree to indemnify and hold FormUpdates harmless from claims arising from your use of the Service, your Customer Data, your communications, or your violation of these Terms or law.
These Terms are governed by the laws of California. Disputes will be brought in Orange County, California courts unless a separate written agreement requires arbitration.
We may update these Terms and will provide notice for material changes. Continued use means you accept the updated Terms.
